Farmer Venkata Subbiah approached the High Court regarding the inclusion of his 1.26-acre land in the banned list in Bachupally, Malkajgiri district. The petition was heard by Justice C.V. Bhaskar Reddy, with advocate Katika Ravinder Reddy representing the petitioner. The petitioner explained that he had purchased the land under a sale deed in 1992 and had regularized it, even receiving government incentives for investment.

The Telangana High Court clarified that the government and its officials do not have the authority to include private property in the banned list. The court stated that the law on this matter is clear and highlighted that decisions made contrary to the guidelines under Section 22-A of the Registration Act are not valid.

The petitioner also pointed out that when he intended to sell the land, paying a registration fee of Rs. 30.35 lakh, his sale was blocked. Orders were issued based on a petition from a person named Zulfiqar Ali Khan, without giving any notice, which the petitioner argued was against the principles of natural justice and violated Section 22-A of the Registration Act. After hearing both sides, the judge confirmed that the government and its officials do not have the authority to add private property to the banned list under Section 22-A. The court directed the authorities to complete the registration process for the petitioner’s land within four weeks.
